The Australian eCommerce Guide website includes a business directory with listings for businesses, products and services relevant to eCommerce in Australia.

In addition to listings added by the publisher of the Guide, the Australian eCommerce Guide includes listings for businesses, products and services that pay to be featured  in the Guide directory.

The inclusion of a listing for a business, product or service in the Guide’s directory should not and cannot be seen as an endorsement or recommendation by the Guide or its publisher of that business, product or service.

Products & Services

The Products and Services available for purchase on the Australian eCommerce Guide website are  primarily Memberships to the Guide and Listings in the Guide. Additional products, consulting, planning sessions, training, workshops and other events may also be offered and available from time to time.  The prices of Listings and Memberships are shown elsewhere on the site, and prices may vary from time to time.  Prices on this site are in Australian Dollars (AUD).

Delivery of our services and products is online by digital download and online access to our membership area. Our Privacy Policies are clearly stated here. We do not collect credit card details. We do maintain SSL encryption for payment-related pages.

Refunds

Our Refund Policy is simple. Full Refunds are available within 7 days of purchase. Here’s how it works: Payments are made in advance for listings and memberships. Full refunds will be given within 7 days of your initial purchase if you decide within that time that you no longer wish to continue with your listing and/or membership with the Australian eCommerce Guide.

If our monitoring software shows that you have joined our site and then downloaded all or most of our member resources within this first 7 day period and you then try to cancel and request a full refund, we may decline your refund request and we may not provide a full refund in such a situation unless you can show that we have materially misled you about an important aspect of the Guide.  If you need to cancel a transaction, then please contact our office by phone or email as above.

General

In order to register as a user or member of the Australian eCommerce Guide, you must read and agree to these Terms and Conditions.

If you use this website without registering as a user, you are deemed to have read, understood, and agreed to abide by the following terms and conditions regardless of how you have accessed the site.  If you do not agree to these Terms and Conditions of use for the website, you must immediately discontinue your use of the Australian eCommerce Guide and this website.

The terms used hereafter as “the Guide”, “the site” or “the Site” or “the website”, “We”, “us”, “our” “ourselves” all refer to the Australian eCommerce Guide. “You”, “visitor”, and “your” refer to any person accessing the website and accepting the Guide’s terms and conditions. “Party” and “parties” refer to both visitors and the Guide. The above terminology is applicable regardless of its use in singular, plural, capitalisation with and/ or, he/she/they being accepted as interchangeable and referring to the same.  These terms and conditions are interpreted and governed in accordance with Western Australian law.

The idea and/or concept of the Australian eCommerce Guide and all the content of the site is protected by copyright and current and relevant intellectual property rights law as applicable in Australia and internationally. The website may not be reproduced for commercial use in any form, in part, whole or otherwise without express written consent from us. Failure to do so may result in legal action. However, you may download, view, copy, and/or print content from the site for personal use and to provide guidance to your business in its ecommerce-related activities, provided you do not alter or modify this content in any way.

The Australian eCommerce Guide accepts no responsibility or liability with relation to any damage or loss that you may incur as a result of using or accessing the Site, which includes damage to your software or hardware.

The Australian eCommerce Guide cannot guarantee that the functions contained within the Site content such as hyperlinks will be error free and uninterrupted, nor that defects will be corrected, nor that the server providing such functions will be free of viruses or bugs.

The Australian eCommerce Guide undertakes to use reasonable commercial efforts to maintain that the information contained on the Site is correct but is not liable in any way for any actions that may arise from incorrect use of that information or incorrect information itself.

You indemnify the Australian eCommerce Guide and its affiliated companies and associates, and each of their directors, officers, employees, and agents against any claim, action, expense or loss incurred as a result of usage of the Site.

The Guide may include hyperlinks to unrelated third party websites in which the Guide has no control or interest. Such links do not indicate any relationship or endorsement of said third party, nor its site, products, or services advertised.

The Guide may include hyperlinks to third party websites that pay some financial compensation to the Guide for providing information on the business in the Guide, and that compensation may be by way of pre-paid advertising fees, listing fees, membership fees or post-paid direct sales commissions or affiliate sales commissions.

 

Content Contributions

The submission by you of content in any format including but not limited to text, graphics, audio, video, and photographs grants the Guide a non-exclusive, perpetual licence to publish such content, royalty-free. Such content can be used or not used  by us in the Guide as we see fit at any time now or in the future.

You agree that submission of such content abides by copyright and other rights and laws for its publication and that such content is neither defamatory, offensive, nor infringes on any laws.

You indemnify the Guide against all legal costs, expenses and/or damages if any as a result of any breach of the above agreement.

Your moral rights are waived for the purposes of submission and publication of your content on the Site.

 

Upgraded Profile Listings

Any business that is an Australian Online Merchant with an Australian ABN and that provides online sales, ordering and payment transaction processing can apply to be listed as an Aussie Online Merchant in the Guide.

Any business that is Service Provider providing eCommerce-related services to Australian Online Merchants can apply to be listed as a Service Provider in the Guide.

Basic listings for Aussie Online Merchant and Service Providers are free of charge.

Any business that meets the requirements for listing in the Guide may apply for their listing information to be upgraded without prejudice. The upgraded profile listing includes additional information provided by you such as, but not limited to, customer information, customer testimonials and references, sales information, awards received, website links and details of your expertise and experience.

As you create and/or modify your listing, you get to choose what information you include and what you say in the Description of your business in the Guide. We have the right to change, review edit, add to, alter and/or delete any content provided by you. If we do make changes to your listing information, we may not discuss such changes with you and take no responsibility to do so.

The costs for such upgrades are displayed on various Pricing pages.

The upgraded profile will be displayed for as long as the payment is in effect. Should payment fail or cease, the upgraded profile will no longer be displayed. This removal of the profile listing may occur without any notification. It can be reinstated upon payment of relevant costs.

Listings are displayed in the order determined by us or in random selection order as determined by the website system or as sorted by users of the site. If you have paid a premium to be displayed above other listings, then premium listings will be displayed in the order determined by us or in random selection order as determined by the website system or as sorted by users of the site. We take no responsibility for the specific order in which listings appear on the site.

Upgraded profile listings can include your physical business address and a map reference which may be displayed on your listing in a Google Map. We take no responsibility for the reliability or continued operation of the Google Map software and technology.

A business seeking to upgrade its listing may be declined and refused for any reason and solely at the discretion of the owners of the Site. Should a listing be refused, any money paid for such upgraded listing will be reimbursed.

 

Advertising & Sponsorships

Users and members of the Australian eCommerce Guide may be offered the opportunity to advertise on the Guide. Costs to advertise are dependent on the placement of the advertisement. Such placements are sold on a first come, first serve basis. The minimum placement for an advertisement is 3 months, payable in advance.

Advertisements placed on main site pages are sold on a first come first served basis. Where there are two or more advertisers interested in the same position or page, the selection will be solely at our discretion.

 

Artwork & Advertisements

Artwork and advertisements are to be provided by you. Where there is no artwork provided a charge will be applied.

 

Payments & Subscriptions

The Guide only accepts payments in advance for any products sold and/or services rendered including but not limited to setting up upgrading profile listings, hosting annual membership, featured and non-featured services listings, advertising, and sponsorships.

All payments accepted online are completed through third party services including but not limited to Paypal and Pin Payments. The Guide accepts no liability for any errors arising as a result of any such transactions with Paypal or Pin Payments. Should you not wish to pay online, then you may do so via invoice, phone, mail, or otherwise as agreed with us.

The responsibility to maintain that available funds are in your account in order for the payment or subscription to be processed remains your own. The Guide accepts no liability for loss of earnings by owners of listings that are not upgraded as a result of lack of funds and non-processing of payment.

 

Cancellations & Refunds

Once you have purchased listings in the Guide or paid membership or  subscribed or pre-paid funds to the Guide, there is no refund available for that year, unless you can show that we have materially misled you about an important aspect of the Guide. Any unused portion of time remaining will be forfeited. As stated above, you do have 7 days from the date of your purchase to request a Full refund.  Payments are made in advance for listings and memberships.
